दिल्ली हाई कोर्ट से अरविंद केजरीवाल को कोई अंतरिम राहत नहीं ईडी ने 2 अप्रैल तक जवाब देने को कहा
अदालत ने ईडी की हिरासत से रिहाई की मांग करने वाली केजरीवाल की अंतरिम याचिका पर जवाब देने के लिए ईडी को 2 अप्रैल तक का समय दिया और मामले पर आगे विचार के लिए 3 अप्रैल की तारीख तय की।
दिल्ली उच्च न्यायालय ने बुधवार को दिल्ली के मुख्यमंत्री अरविंद केजरीवाल को रिहा करने के लिए कोई अंतरिम आदेश पारित करने से इनकार कर दिया, जिन्हें दिल्ली उत्पाद शुल्क नीति घोटाले से जुड़े मनी लॉन्ड्रिंग मामले में गिरफ्तार किया गया था और प्रवर्तन निदेशालय (ईडी) की हिरासत में है।
न्यायमूर्ति स्वर्ण कांता शर्मा ने एजेंसी द्वारा उनकी गिरफ्तारी को चुनौती देने वाली केजरीवाल की याचिका पर नोटिस जारी किया।
कोर्ट ने कहा कि केजरीवाल की याचिका में मांगी गई राहत की प्रकृति को देखते हुए, ईडी को सुने बिना आदेश पारित नहीं किया जा सकता है।
कोर्ट ने कहा, “इस अवसर को अस्वीकार करना निष्पक्ष सुनवाई से इनकार करने के साथ-साथ प्राकृतिक न्याय के सिद्धांतों में से एक का उल्लंघन होगा, जो कि दोनों पक्षों पर लागू होता है, किसी एक पर नहीं।”
इसलिए, अदालत ने अंतरिम राहत के लिए दिल्ली के सीएम की याचिका पर नोटिस जारी किया लेकिन कोई अंतरिम आदेश पारित करने से इनकार कर दिया।
न्यायमूर्ति शर्मा ने कहा कि अंतरिम आवेदन में राहत देना अंतिम राहत देने के समान होगा।

तदनुसार, अदालत ने ईडी की हिरासत से रिहाई की मांग करने वाली केजरीवाल की अंतरिम याचिका पर जवाब देने के लिए ईडी को 2 अप्रैल तक का समय दिया और मामले पर आगे विचार के लिए 3 अप्रैल की तारीख तय की।
केजरीवाल को 21 मार्च को दिल्ली उत्पाद शुल्क नीति मामले में ईडी ने गिरफ्तार किया था।
यह मामला दिल्ली के लेफ्टिनेंट जनरल वीके सक्सेना द्वारा दायर 2022 की शिकायत में निहित है, जिसमें 2021-22 के लिए दिल्ली उत्पाद शुल्क नीति के निर्धारण में अनियमितताओं का आरोप लगाया गया है।

Justice Sharma said that granting relief in the interim application would be tantamount to granting final relief.
“This Court is conscious of the fact that in order to arrive at a conclusion whether the petitioner deserves immediate release or not, this Court will necessarily have to decide the issues raised in the main petition, since those issues form the basis of the arguments. Senior counsel for the petitioner sought the immediate release of the petitioner,” the court order said.
Accordingly, the court gave time till April 2 to the ED to respond to Kejriwal’s interim plea seeking his release from ED custody and fixed April 3 for further consideration of the matter.
Kejriwal was arrested by ED on March 21 in the Delhi Excise Policy case.
The case lies in a 2022 complaint filed by Delhi Lieutenant General VK Saxena, alleging irregularities in the determination of the Delhi Excise Policy for 2021-22.
